»The Liability of Upskirting. A Phenomenological and Criminal Law Analysis of so-called Upskirting on the Occasion of the Introduction of Section 184k of the German Criminal Code (StGB) by the 59th Amendment to the Criminal Code (59. StRÄndG)«: This thesis examines the phenomenon of upskirting, analysing in particular the possible sanctions under criminal and administrative law before Section 184k of the German Criminal Code (StGB) comes into force in 2021. The focus is on implications under international and constitutional law, in particular a possible obligation to impose and the legitimacy of imposing penalties under criminal law. Furthermore, it takes an in-depth look at questions concerning the application of Section 184k StGB.
